A law we thought was buried

As European regulators expand Chat Control, more businesses are turning to Chat Control self-hosting to keep their communications out of reach of third-party scanning.

On July 9, 2026, the European Parliament re-adopted “Chat Control 1.0” a text that had actually been rejected just three months earlier (March 26, 2026, 311 votes against, 228 in favor). In the meantime, the Council of the EU brought the file back through an emergency procedure, and the regulation is now in force until April 3, 2028.

Many of our clients and partners across Côte d’Ivoire, Senegal, Benin, Togo, Cameroon, Congo, and Luxembourg have been asking us the same question: “Are my business messages going to be scanned?”

We owe you a clear answer no fearmongering, no downplaying. Then we’ll walk through the concrete alternatives.

Demystifying: what does the text actually say?

There are two distinct texts, frequently confused in the press:

Chat Control 1.0 the one just adopted is a temporary derogation from the EU’s ePrivacy directive. It allows large platforms (Gmail, Meta, Microsoft Teams, Discord…) to voluntarily scan the content of unencrypted messages passing through their services, with the stated goal of detecting child sexual abuse material.

Chat Control 2.0, officially the CSAR regulation (Child Sexual Abuse Regulation), is a separate, permanent framework still under negotiation. It would go further by mandating scanning even of end-to-end encrypted communications which is why cybersecurity experts consider it the more serious threat to encryption itself. The decisive fight over this part is expected in September 2026.

What matters today:

The scan targets unencrypted content on consumer-facing communication services.
It’s an authorization granted to platforms, not (yet) a general obligation to break encryption.
End-to-end encrypted messengers (Signal, for example) are not currently covered by CC 1.0.
A private, self-hosted communication infrastructure falls outside the scope of the text, which targets large public communication providers not an organization’s internal tools.

Why it matters, even if you have “nothing to hide”

Three concrete reasons, independent of any ideological debate:

Business confidentiality. Any company, firm, or public administration constantly exchanges sensitive information — contracts, client data, strategy. An automated scan, however well-intentioned at the outset, creates an additional access point to that data.
Data sovereignty. Most of the platforms concerned (Gmail, Outlook, Teams) are operated by U.S. companies subject to the Cloud Act, which can compel them to hand over data to U.S. authorities regardless of European or African law. For a business or public institution in francophone Africa, this means communications may pass through an analysis system entirely outside their jurisdiction and control.
Cumulative effect. As several European observers have noted, this derogation fits a broader pattern: financial privacy, travel data, and now communications. Each step is presented as narrow and urgent; the accumulation quietly redraws the balance between security and privacy.

Concrete alternatives

1. What does NOT work

One important technical clarification: there is no browser extension or filter that can block this scanning on Gmail, Teams, or Discord. This isn’t malware you neutralize with antivirus software it’s an analysis performed server-side, by the provider itself, on its own infrastructure. Nothing installed on your device can prevent it.

Similarly, a VPN does not protect against this kind of scanning: it encrypts the transport between you and the server, but once the message reaches Google or Microsoft, it’s read in the clear VPN or not.

2. End-to-end encrypted messaging

For sensitive one-off exchanges: Signal remains the reference, largely because its encryption protocol is open, audited, and the company itself never holds the decryption keys.

3. Encrypted email

For sensitive professional correspondence: services like Proton Mail or Tuta encrypt content end-to-end, unlike Gmail or Outlook.

4. Sovereign self-hosting the structural answer

This is where the real answer lies for a business or institution. Instead of depending on a third-party provider subject to foreign jurisdictions and shifting regulatory derogations, the organization hosts and controls its own communication infrastructure:

Internal messaging and video conferencing via self-hosted Nextcloud Talk, on infrastructure you control (on-premise or sovereign cloud).
Business email on a server whose hosting jurisdiction you choose.
File sharing and collaboration without dependency on a provider subject to the Cloud Act.

The benefit isn’t purely regulatory. It’s a change in posture: your business data stops passing through external analysis systems, regardless of whatever new European or American rules get layered on top of Chat Control in the future.

Short term: move sensitive exchanges to an encrypted messenger (Signal) and encrypted email for critical correspondence.
